Chelsea transfer ban

Post by bluedabadi »

Chelsea banned from buying players until 2011
By Martyn Ziegler, PA
Thursday, 3 September 2009
Chelsea have been banned from registering any new players for the next two transfer windows in a shock move by FIFA after being found guilty of inducing a French teenager to breach his contract with another club.
Gael Kakuta, 18, joined Chelsea from Lens two years ago after which the French club lodged a complaint with FIFA.
Now FIFA's dispute resolution chamber (DRC) has ruled that Kakuta breached his contract with Lens and that Chelsea induced him to do so.
FIFA said in a statement: "The French club had lodged a claim with FIFA seeking compensation for breach of contract from the player and requesting also sporting sanctions to be imposed on the player and the English club for breach of contract and inducement to breach of contract respectively.
"The DRC found that the player had indeed breached a contract signed with the French club. Equally, the DRC deemed it to be established that the English club induced the player to such breach.
"As a result the player was condemned to pay compensation in the amount of EUR 780,000, for which the club, Chelsea, is jointly and severally liable, and sporting sanctions were imposed on both the player and Chelsea in accordance with art. 17 par. 3 and 4 of the Regulations on the Status and Transfer of Players.
"A restriction of four months on his eligibility to play in official matches is imposed on the player Gael Kakuta while the club Chelsea is banned from registering any new players, either nationally or internationally, for the two next entire and consecutive registration periods following the notification of the present decision.
"Furthermore, Chelsea, has to pay RC Lens training compensation in the amount of EUR 130,000."

No doubt they'll worm their way out of it.

Yeah that seems to be the general consensus... not good though with an ageing team if it sticks..

You wonder why these big clubs get hit with sanctions like this? They never stick, and all they do is show how spineless FIFA and UEFA are. By the time this is over, Lens will probably be foreced to pay Chelsea €22 million in compensation for wasting veryone's time with this suddenly unnecessary complaint

It would be great if the ban stuck... funny there wasn't any talk about this before the ban was decided, came out of no where really, any long term injuries to key players will have them in serious sh!t

Media really missed a trick there. It completely slipped under their radar, partly because they assumed Chelsea would get away as usual.

I think the ban will stick, but I don't know if it'll effect them that much. They have a settled squad and plenty of depth. They haven't been that active in the transfer market anyway and probably wouldn't have bought too many players.

The bigger effect is that they won't want to sell fringe players because they won't be able to buy injury replacements.

It might really open the floodgates though... now Man U are being dragged in by another French club:

"United face Fifa transfer investigation
Manchester United seem certain to launch a vigorous defence of their position if the case of former Le Havre youngster Paul Pogba is referred to Fifa.

Chelsea have vowed to appeal against a ban on signing players for the next two transfer windows after being found guilty of improper conduct in their recruitment of Gael Kakuta from French club Lens.

Le Havre have confirmed they are requesting Fifa to investigate the case of Pogba, who they claim had agreed to join them, only to walk out in favour of the Old Trafford outfit.

Fifa have so far failed to register Pogba's arrival at Old Trafford, although United insist they have done nothing wrong.

"It is complete nonsense," a spokesman for United said. "Everything has been done within Uefa guidelines."

However, Le Havre managing director Alain Belsoeur claims to have documentation showing United offered inducements for Pogba to join them and has vowed to include it in submissions to the world's governing body.

"We are still pursuing our case," Belsoeur told The Times. "It is a very serious case. We are confident that we'll win because it is in the best interests not just of our club but of sport.

"We spend €5 million on our academy every year out of a turnover of €12 million. It is a huge investment.

"We do that to give a chance to our players to develop for our first team, not to be an academy for others.

"What is the point of investing in an academy if the players leave at 16? This is clearly a message from Fifa to protect the education system.""

As predicted, Chelsea get away with it!

Chelsea transfer ban lifted
Soccer: Chelsea have been cleared of any wrongdoing over the Gael Kakuta affair and are no longer banned from signing players.

The Blues were hit with an 18-month transfer embargo in September after Fifa ruled that they were guilty of inducing Kakuta, then 16, to break a contract with Lens back in 2007.

Chelsea appealed to the Court of Arbitration for Sport (CAS) and it was decided that the ban would be suspended, allowing the club to bolster their squad in January.

CAS have now ruled that Chelsea did not break any rules over the signing of Kakuta and the embargo has been lifted entirely.

A statement from CAS read: "The Court of Arbitration for Sport (CAS) has issued an award today ratifying the agreement reached by Chelsea FC, Racing Club de Lens and the French football player Gaël Kakuta, putting an end to this arbitration procedure which also involved FIFA.

"The CAS has noted that, in the agreement, the two clubs and the player have recognised that the contract between the player and RC Lens was not valid.

"Accordingly, the player could not have terminated it prematurely and without just cause and FC Chelsea cannot therefore be liable for inducing a breach of contract.

"As a consequence, in light of these new circumstances, the sanctions imposed upon Chelsea FC and the player by the Fifa Dispute Resolution Chamber had to be lifted."
